1. Keep the legal deadline separate
If a foreclosure case or sale is pending, contact counsel promptly and verify the current case status through the appropriate official source. Submitting a financing request does not stop a case, postpone a sale or extend any deadline. Do not wait for a financing response to address a legal deadline.
2. Clarify the objective
Is the homeowner trying to keep the property, sell it, resolve arrears or evaluate a short-term financing option? Ask what has already been discussed with the servicer. A financing review is one possible step; it does not replace legal advice or a discussion of available loss-mitigation options.
3. Bring reliable property and debt information
Prepare the county, property type, occupancy and estimated value with its source. Identify the current mortgage, other liens and known tax or association obligations. Obtain current debt figures from the appropriate creditor or servicer; an old statement may not reflect what is needed for the proposed transaction.
4. Identify what could prevent financing
Insufficient equity, unresolved title issues, lack of authority to sign, property condition, an unworkable repayment plan or insufficient time to complete lender requirements can prevent a loan. Identifying these issues early helps avoid building a legal strategy around unconfirmed funding.
5. Ask specific questions about the exit
For a proposed bridge loan, ask how repayment will occur and what happens if a sale or refinance is unavailable. A later refinance requires separate qualification. Available bridge terms are up to 36 months in most cases, with no pre-payment penalty; the actual transaction still requires individual review.
