Foreclosure Defense

Foreclosure defense buys a client time; when the client has real equity, a foreclosure bridge loan can turn that time into a payoff. Credit is not part of qualification for the equity-based foreclosure program.

Probate

Estate files stall on money more often than on law — arrears on an inherited home, or one heir who wants to keep the house. I review probate and heir-buyout financing while the estate is still open, coordinated with counsel and title.

Family / Divorce

When one spouse keeps the home, someone has to fund the other spouse's share of the equity. I review whether buyout and refinance financing fits the agreement counsel is drafting — before it's signed, not after.

Case scenario

A Kendall couple is divorcing, and the marital settlement agreement gives one spouse the house — as long as they pay the other spouse's share of the equity, roughly $180K, by a deadline written into the agreement. The spouse keeping the home just went from two incomes to one, so a conventional cash-out refinance doesn't work on paper yet. Counsel drafts the buyout and the title transfer so the terms are clear. Reinier reviews an equity-based loan that funds the buyout at closing, so the agreement can be performed as written. Once the new income is documented, the plan is to refinance into long-term financing — no pre-payment penalty, so the client can move the moment they qualify.

Bankruptcy

When a client in bankruptcy still has equity in the home, I review the financing side with counsel — including any court authorization the case requires. The foreclosure bailout loan is usually where that conversation starts.

Case scenario

A Doral homeowner is two years into a Chapter 13 plan that isn't holding. Post-petition mortgage payments slipped, the servicer filed a motion for relief from stay, and the house still carries about $250K in equity. The client wants to keep it. Bankruptcy counsel files a motion asking the court to authorize new financing; Reinier structures an equity-based loan that, with court approval, pays off the existing mortgage and the arrears in a single closing. The bankruptcy on the credit report doesn't drive the decision — equity, title and the court's authorization do. The exit is a sale or a refinance, with no pre-payment penalty.

Real Estate Litigation

Partition actions, quiet title and co-owner disputes often settle the day one side can actually fund a buyout. I review equity-based and investment-property financing that lets a settlement close instead of stalling.

Case scenario

Two former business partners co-own a Little Havana fourplex through an LLC. The relationship broke down, one filed a partition action, and the building has sat in litigation for over a year with a lis pendens on title. Their attorneys negotiate a settlement: one partner keeps the property and buys the other out. The settlement only works if the money shows up. Reinier reviews an investment-property loan based on the building's equity and rents that funds the buyout at closing, with title clearing the lis pendens in the same transaction. The settlement closes, the case is dismissed, and nobody waits on a court-ordered sale.
